Real estate law is a branch of law, predominantly private, that deals with the relationship between people and immovable property.
Given the importance of real estate, housing and the right to property in our society, real estate law is part of the daily life of a large part of the population directly and, it can be said, of the entire population indirectly.
The most common relationships dealt with by this branch of law are those relating to the use of immovable property, such as leasing, lending, guarantees, in addition to transactions involving real estate, such as purchase and sale, donation, transformation of the property, either by accessions physical or merely legal ones such as incorporation, condominium institution, among others.
Condominium Law, which is part of the real estate law branch, establishes the rules for harmonious coexistence between co-owners and is subdivided into simple condominium and building condominium, being more publicly associated with this second type.
It specifically regulates the basic rights and obligations of joint-owners before the community in relation to the use of property and common things, in addition to the rules for apportionment of expenses, form and participation in the deliberations that govern the daily life and administration of the condominium.
Despite the constant confusion between condominium law and neighborhood law, the relationship exclusively between neighbors is more related to neighborhood law, linked to property law, than to condominium law.
The Neighborhood Law has a greater relationship with personality (interpersonal) rights than with the people with the property, but in several circumstances the origin of the conflict is the relationship between real estate or real estate and people, a situation in which it is related to the right to real estate.
Urban or Urban Law, on the other hand, is the branch of law related to the legal relations of the development of cities, such as land use and occupation, territorial planning and social well-being.
There is a great interface between urban law and real estate law.
